1. Important legal notices

1.1 Consumer rights not affected. Nothing in these Terms limits or excludes your statutory rights where you are a UK consumer (including rights for faulty goods under the Consumer Rights Act 2015 and any rights under the Consumer Contracts Regulations where applicable).

1.2 Business customers. If you purchase on behalf of a business, additional and/or different terms may apply (including stricter limitations of liability). We may treat an order as business-to-business where there are reasonable indicators (for example: VAT invoice request, bulk ordering, trade email domain, or delivery to business premises), unless you notify us otherwise before ordering.

1.3 English language governs. If translations are provided, the English version prevails.

We operate and sell to customers in the United Kingdom and internationally where available at checkout.

3. Definitions

  • Consumer: An individual acting for purposes mainly outside their trade/business.
  • Products: Wall art and related items we sell (for example: canvas prints, fine art paper prints, frames, hanging kits, and upgrades).
  • Made-to-order: Produced and printed after you place an order and payment is confirmed. This includes printing, finishing, framing (where selected), packaging, and quality checks carried out to fulfil your order.
  • Custom/Personalised: Products that are made to your specifications or clearly personalised (for example: photo upload prints; personalised text; bespoke sizing outside the options listed on the Site; special cropping/layout instructions you provide; or any other made-to-specification request we confirm in writing). Where a Product is Custom/Personalised, the statutory right to cancel for change of mind may not apply as permitted by law.
  • Content: Text, images, artwork previews, product photos, filters, and other Site materials.

4. Changes to these Terms

4.1 We may update these Terms to reflect changes to the Site, Products, operations, security, or legal requirements.

4.2 The Terms displayed at the time you place an order apply to that order (unless a change is required by law to apply sooner).

5. Eligibility and accuracy of information

5.1 By placing an order, you confirm that you are at least 18 years old, or that you have the permission of a parent or legal guardian to place the order and make payment.

5.2 You confirm that the information you provide (including delivery address, contact details, and any custom instructions) is accurate and complete.

5.3 We are not responsible for delays, losses, or misprints caused by incorrect information you provide, except where required by law.

6. Site access, availability and acceptable use

6.1 You agree to use the Site lawfully and respectfully.

6.2 We do not guarantee the Site will be uninterrupted, error-free, or always available. We may suspend or restrict access for maintenance, security, legal, or operational reasons.

6.3 You must not attempt to disrupt, damage, or hack the Site, including:

  • introducing malware or harmful code;
  • attempting unauthorised access to accounts, servers, or data;
  • using automated scraping/crawling without our written permission;
  • bypassing access controls or rate limits.

6.4 We may suspend or block access where we reasonably suspect misuse, fraud, or unlawful activity.

7. Prohibited conduct and unlawful content

7.1 You must not use the Site or our communications to:

  • harass, threaten, intimidate, or abuse anyone;
  • impersonate other people, artists, brands, our staff, or representatives;
  • post/upload content that is defamatory, obscene, hateful, discriminatory, or otherwise unlawful;
  • post/upload content that infringes copyright, trade marks, privacy, or publicity rights;
  • post spam, commercial advertising, or solicit users for other services;
  • encourage criminal activity or violate any law.

7.2 We may remove content, refuse service, cancel orders, or restrict accounts where we reasonably believe this section is breached.

8. Accounts (if offered)

8.1 You are responsible for maintaining the confidentiality of your login details.

8.2 You must notify us promptly if you suspect unauthorised use of your account.

8.3 We may suspend or close an account if we reasonably suspect fraud, unauthorised access, repeated abuse, or repeated unjustified chargebacks.

9. Product information, previews and tolerances

9.1 We aim to describe Products accurately, including size, materials, frame type, and finish.

9.2 Colour and appearance. Colours may vary due to screen settings and calibration. Natural materials (including wood grain/finish variations) and handmade items may have minor variations that do not affect function or quality.

9.3 Previews and cropping. Product images and previews are illustrative. Where a preview/crop tool is available, it is guidance only and final cropping may vary slightly depending on size/ratio and production requirements.

9.4 Tolerances. Due to production and finishing processes, minor tolerances may occur (for example: small trimming/cropping differences, alignment tolerances, or slight variations in finish). These are not defects unless they materially affect the appearance or use of the Product.

10. What we sell

10.1 Canvas prints may be gallery-wrapped (image may continue around edges where shown), stretched over a solid wood frame, and supplied ready to hang where stated.

10.2 Fine art paper prints may be produced on archival-quality paper where stated.

10.3 Frames and upgrades may include solid wood frames and floating frame upgrades where offered.

10.4 Limited editions (if offered) may be capped by quantity/size. Numbering/certificates are included only if stated on the product page.

11. Orders and contract formation

11.1 When you place an order, you are making an offer to buy Products.

11.2 You will receive an order acknowledgement (this does not guarantee acceptance).

11.3 A binding contract is formed when we send a dispatch confirmation or dispatch the Products (whichever occurs first).

11.4 We may refuse or cancel an order if we reasonably believe payment is not authorised, there is an error, the Product is unexpectedly unavailable, or the order appears fraudulent or unlawful.

12. Prices, VAT, promotions and payment

12.1 Prices are shown in GBP (£) unless stated otherwise.

12.2 VAT is included/excluded as stated at checkout and on your receipt/invoice.

12.3 Delivery costs (if any) are shown at checkout before you pay.

12.4 Payment is taken at checkout using the methods displayed on the Site.

12.5 If payment fails, is reversed, is charged back, or is reasonably suspected to be unauthorised, we may pause production, delay dispatch, request additional verification, and/or cancel the order.

12.6 Promotions. Promotion codes and offers are subject to stated terms, may be withdrawn at any time, and may exclude certain products, sizes, upgrades, or delivery services.

13. Errors and mispricing

13.1 If a Product is listed at an incorrect price or with materially incorrect information due to an error, we may refuse or cancel the order. If you already paid, we will refund the amount paid for that order.

13.2 We are not responsible for minor typographical or photographic errors that do not materially affect your purchase decision, but we will aim to resolve issues fairly.

14. Production and made-to-order

14.1 Many Products are made-to-order. Production usually begins after payment confirmation.

14.2 Any production, dispatch and delivery times shown on the Site (including any countdowns or estimated dates) are estimates only and are not guarantees. Times may vary due to peak demand, quality control checks, supplier availability, carrier/courier disruption, address issues, or events outside our reasonable control. Where we reasonably need to do so, we may update estimated timelines and/or use an alternative carrier or service level to complete delivery.

15. Custom / personalised orders (including photo uploads)

15.1 If we offer a “photo to art” or upload feature:

  • you confirm you own the copyright or have permission from the owner;
  • you confirm you have permission from any identifiable persons in the image where required;
  • you grant us a limited licence to reproduce the image only to fulfil your order.

15.2 We may refuse custom content that we reasonably believe infringes third-party rights, is unlawful/hateful/abusive, or is technically unsuitable for quality printing.

15.3 You are responsible for confirming spelling, cropping instructions, and the suitability/quality of any uploaded image. We are not responsible for issues caused by low-resolution files, incorrect instructions, or content you do not have rights to, except where required by law.

16. Delivery (UK)

16.1 We deliver to UK addresses available at checkout.

16.2 Delivery dates are estimates, not guarantees.

16.3 For UK consumers, the Products remain at our risk until they come into the physical possession of you or a person you have identified to take possession of the Products on your behalf (for example, a neighbour you nominate or a safe place option you have expressly authorised).

16.4 If outer packaging arrives damaged, take photos of the packaging and item and contact us as soon as reasonably possible.

16.5 Missed delivery / access issues. If delivery fails due to an incorrect address, failure to collect, or no safe access, the courier may return the parcel or attempt re-delivery. Any re-delivery, storage, or return-to-sender costs may be charged to you to the extent permitted by law.

17. Cancellations and order changes

17.1 Cancellation / change requests (strict time window): Because our production process starts quickly, you must email any cancellation or change request within 12 hours of placing your order. Your email must include your order number in the subject line exactly like this: “Cancellation Request – Order #____”.

17.2 After 12 hours / once production starts: After the 12-hour window (or once production has started, whichever happens first), cancellation or changes may not be possible, especially for Custom/Personalised items. If we are able to cancel after work has started, any refund may be reduced by a reasonable amount to reflect costs already incurred, where permitted by law.

17.3 Statutory rights: This section does not limit your statutory rights as a UK consumer, including rights for faulty goods and any legal cancellation rights that apply where the Product is not exempt.

18. Returns, refunds, and exchanges (UK consumers)

18.0 Scope. This Section 18 applies to UK consumers only. If you are ordering for delivery outside the UK, different rules may apply depending on the destination country. Unless we state otherwise in writing, international orders are not eligible for “change of mind” returns and any return (if agreed) will be subject to our instructions and the customer bearing all shipping, taxes and duties, except where mandatory local law requires otherwise.

18.1 Made-to-order notice (important)

18.1.1 All of our Products are produced to order (printed and finished after you place your order and payment is confirmed). This means we begin processing quickly and each order is prepared specifically for dispatch to you.

18.2 Statutory cancellation right (where it applies)

18.2.1 If you are a UK consumer and your purchase is not exempt, you may have a legal right to cancel your order within 14 days starting the day after you receive the goods.

18.2.2 To exercise a statutory cancellation right, you must tell us clearly that you want to cancel (for example by email). For faster processing, please include your order number in the subject line as: “Cancellation / Return – Order #____”.

18.2.3 If you cancel under a statutory cancellation right, you must send the goods back to us within 14 days of telling us you want to cancel.

18.3 When the 14-day “change of mind” right does NOT apply (custom/personalised exemption)

18.3.1 The statutory 14-day right to cancel for change of mind does not apply to goods that are made to your specifications or are clearly personalised (for example: photo upload prints, bespoke sizing outside listed options, personalised text, or special cropping/layout instructions).

18.3.2 Where an order is Custom/Personalised (as defined in Section 3), returns for “change of mind” are not automatic and will only be considered under our goodwill policy in Section 18.6 (if offered and if we confirm eligibility).

18.3.3 This does not affect your statutory rights if goods are faulty, damaged, or not as described.

18.4 Condition of returned goods and inspection (applies to all returns)

18.4.1 You must take reasonable care of the Products while they are in your possession. Where the law allows, we may reduce any refund to reflect loss in value resulting from handling beyond what is necessary to inspect the goods (for example: mounting, hanging, installing, marking, scratching, bending, exposure to smoke/moisture, or returning without suitable protection).

18.4.2 Returns must be securely packaged to prevent damage in transit and should include all items supplied (for example: frames, hanging kits, certificates if included, and protective corners). We may refuse or delay processing where a return arrives incomplete or is damaged due to inadequate packaging.

18.5 Return authorisation (RMA) and strict process

18.5.1 RMA required for processing: Before sending any item back, you must request a Return Merchandise Authorisation (“RMA”) from us by emailing at  support@rightart.co.uk with your order number and the reason for return. We will confirm whether the return is eligible and provide the correct return address and instructions.

18.5.2 Returns sent without an RMA (or sent to an address other than the one we provide) may be refused, returned to sender, or delayed, because we may be unable to identify the order, track the parcel, or process it safely.

18.5.3 Evidence requirements: For any claim of damage, defect, or “not as described”, you must provide clear photographs and any details we reasonably request to assess the issue.

18.6 Our “You’ll Love It” goodwill returns policy (optional and discretionary)

18.6.1 Where a statutory cancellation right does not apply (including Custom/Personalised items), we may, at our discretion, offer a goodwill return if you are not satisfied.

18.6.2 Goodwill returns are only considered if:

  • you contact us within [14] days of delivery;
  • we issue an RMA and you follow our return instructions;
  • the Product is returned in original condition (unhung/unused, no marks, no damage) and securely packaged.

18.6.3 For goodwill returns (if approved):

  • original delivery charges are not refundable;
  • the customer is responsible for all return shipping costs and we recommend a tracked/insured service;
  • we may refuse a goodwill return if the Product shows handling/usage beyond inspection or arrives damaged due to poor packaging.

18.6.4 This goodwill policy is optional, can be withdrawn at any time, and does not reduce your statutory rights.

18.7 Faulty, damaged, or not as described (Consumer Rights Act 2015)

18.7.1 If your Product is faulty, damaged, or not as described, you may have statutory remedies (which can include repair, replacement, or refund depending on circumstances and timing).

18.7.2 Return-before-replacement (strict): Unless we agree otherwise in writing, any faulty/damaged Product must be returned to us and received at our return address before we dispatch a replacement.

18.7.3 If the claim is approved and a return is required, we will cover reasonable return shipping costs or reimburse them after receipt (using a standard tracked service unless we agree otherwise). Reimbursement may take up to 30 days after we receive the returned Product and any required proof of postage.

18.7.4 We reserve the right to refuse claims where damage is caused by misuse, improper installation/hanging, unsuitable fixings, accidents, or failure to follow care instructions.

18.8 Refund timing and method

18.8.1 Refunds (if approved) are issued to the original payment method unless otherwise agreed.

18.8.2 Where a statutory cancellation right applies, we may withhold the refund until we receive the goods back or you provide evidence that you have sent them back.

18.8.3 For goodwill returns, refunds (if approved) are processed only after we receive and inspect the returned Product and confirm it meets the goodwill conditions.

19. Model cancellation email (recommended)

20. Lifetime colour warranty (our warranty) (if offered)

20.1 We provide a lifetime colour warranty under normal indoor display conditions. This warranty is offered in addition to, and does not affect, your statutory rights.

20.2 Normal indoor conditions generally means: kept indoors; away from prolonged direct sunlight; away from damp/condensation/smoke residue/extreme heat; and cleaned gently with no harsh chemicals or abrasives. It also excludes prolonged direct exposure to strong indoor light sources, including spotlights and any light source that emits UV (for example UV lamps or UV-emitting bulbs) at close range.

20.3 Remedy (replacement only) If verified fading/print defects occur under normal indoor conditions, we will, after approval, provide a replacement of the same artwork and size (or the closest available equivalent if discontinued). No cash refunds are provided under this warranty.

20.4 Claims process and exclusions This warranty does not cover accidental damage, misuse, improper hanging, unsuitable wall fixings, or damage caused by sunlight, moisture, heat, fire, flooding, chemicals, or direct/prolonged exposure to strong indoor lighting as described above. Unless we agree otherwise in writing, the faded/defective Product must be returned to our return address and received by us before we dispatch any replacement.

21. Natural materials and handmade finishes

21.1 Frames may be handmade from solid wood.

21.2 Natural variations may include differences in grain patterns, slight tone/finish variation, and minor hand-finishing characteristics.

21.3 These are normal and not considered defects unless they materially affect structure or display.

22. Intellectual property and trademarks

22.1 All Site Content is protected by copyright and other intellectual property laws.

22.2 When you purchase a print, you own the physical item, but you do not acquire any copyright/licensing rights in the artwork image. You may not reproduce, distribute, create derivative works from, or commercially use the artwork without permission from the rights holder.

22.3 Except as permitted by law, you must not copy, reproduce, download, print, republish, distribute, transmit, modify, create derivative works from, or commercially exploit any Site Content without our prior written permission (or the permission of the relevant rights holder). All rights are reserved.

22.4 Our brand names, logos, and product/service names are our trade marks (or those of licensors). Other trade marks belong to their respective owners.

23. User submissions (reviews, photos, testimonials)

23.1 If you submit content to us (“Submissions”), you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use it for marketing and Site display (including cropping/formatting), to the extent permitted by law.

23.2 You represent and warrant that you own or control the rights to the Submission and that people shown have consented where necessary.

23.3 No compensation is owed for Submissions unless agreed in writing.

23.4 We may remove Submissions at our discretion.

23.5 You must not submit reviews, testimonials, photos or other content that is false, misleading, impersonates another person, or is submitted in exchange for undisclosed incentives.

23.6 We may take reasonable steps to detect, investigate and remove reviews or Submissions we reasonably believe are fake, unlawful, or breach these Terms (including where we suspect manipulation, incentivisation without disclosure, or misuse of review systems).

24. Privacy, cookies and marketing

24.1 We process personal data according to our Privacy Policy and Cookie Policy.

24.2 Individuals have rights under UK GDPR. For details and how to exercise rights, see our Privacy Policy and/or contact [Support email].

25. Third-party links and services

25.1 The Site may contain links to third-party websites or services. We are not responsible for third-party content, policies, or services.

26. Force majeure (events outside our control)

26.1 We are not liable for delays or failures caused by events outside our reasonable control (for example: courier disruption, severe weather, supplier issues, labour disputes, or system outages).

27. Limitation of liability

27.1 Nothing in these Terms limits or excludes liability where it would be unlawful to do so (including for death/personal injury caused by negligence, fraud, or fraudulent misrepresentation).

27.2 Subject to 27.1, and to the maximum extent permitted by law, we are not liable for indirect or consequential losses, delays outside our control, loss of profits, loss of business, loss of goodwill, or losses arising from misuse, improper installation, unsuitable wall fixings, or improper care of Products.

27.3 This section does not affect your statutory consumer rights.

28. Indemnity

28.1 You agree to indemnify and hold us harmless from losses, damages, and reasonable costs arising from:

  • your breach of these Terms;
  • your unlawful use of the Site;
  • your upload/submission of content you do not have rights to (including copyright/privacy violations).

29. Fraud prevention, abuse and chargebacks

29.1 We may take reasonable steps to prevent fraud and may request additional verification before production or dispatch.

29.2 Where we reasonably believe there is abuse (including repeated unjustified chargebacks, false claims, or attempted fraud), we may suspend accounts, cancel orders, refuse service, and/or restrict future purchases to the extent permitted by law.

29.3 Chargebacks. If you raise a chargeback without first contacting us and allowing a reasonable opportunity to investigate and resolve the issue, we may treat this as abuse and may restrict future orders (to the extent permitted by law). This does not affect your legal rights.

30. Termination and suspension (Site access)

30.1 These Terms apply from the moment you access the Site.

30.2 We may suspend or terminate access (or accounts) without notice where we reasonably believe you breached these Terms, used the Site unlawfully, or attempted fraud/abuse.

31. Notices

31.1 We may send notices by email, a notice posted on the Site, or other reasonable methods to the contact details you provided.

32. Miscellaneous

32.1 Entire agreement: These Terms, plus any policies referenced (Privacy, Returns, Cookies), form the full agreement.

32.2 Severability: If any clause is found unenforceable, the rest remains in force.

32.3 No waiver: If we do not enforce a clause immediately, it does not mean we waive it later.

32.4 Assignment: We may transfer our rights/obligations under these Terms as part of a business change (sale/merger), without reducing your consumer rights.

33. Governing law and jurisdiction

33.1 These Terms are governed by the laws of England and Wales.

33.2 Courts of England and Wales will have jurisdiction, subject to mandatory consumer protections.

34A.2 ADR information: If we cannot resolve a complaint through our internal process, we will provide you with information about an approved Alternative Dispute Resolution (ADR) provider and let you know whether we agree to use ADR to resolve the dispute, as required by applicable law.
